Welcome to Swiftlendly. These Terms of Use ("Terms") are an agreement between you and the operator of this website (the "Website Operator"). "Swiftlendly" and the "Website" mean the website at swiftlendly.com and the loan request service it provides. Please read these Terms before using the Website. By using the Website or submitting a loan request (a "Financing Request"), you agree to these Terms. If you do not agree, please do not use the Website.
We have tried to write these Terms in plain language. A few sections use more formal wording because the law requires precision there. If anything is unclear, you can contact us using the contact methods published on the Website.
1. What Swiftlendly is, and what it is not
Swiftlendly is a lead-generation service for consumer personal installment loans. Here is what that means:
- The Website Operator is not a lender. It does not make loans, make credit decisions, set rates or terms, or fund anything.
- When you submit a Financing Request, the Website Operator stores your information and, only with the consents you give during submission, shares or sells it to independent lenders, lending networks, and routing platforms (together, "Participating Providers").
- Submitting a Financing Request does not guarantee anything. It does not guarantee approval, contact from a lender, an offer, funding, or any particular amount, rate, fee, payment, or term.
- The Website does not compare every lender or loan product available. You are free to seek financing anywhere else, at any time.
- The Website Operator may be paid by Participating Providers when your Financing Request is submitted, routed, accepted, or purchased. Section 5 explains how this can affect where your request is sent.
- The Website does not provide legal, tax, accounting, investment, or financial advice. Review any loan offer carefully and consult your own advisers if you need help deciding.
2. Who may use the Website
You may use the Website and submit a Financing Request only if all of the following are true:
- You are at least 18 years old.
- You live in the United States.
- You are requesting a loan for yourself, using your own information, for your own personal use.
- You have the legal capacity to enter into a binding agreement.
You may not submit a Financing Request on behalf of another person unless you have clear legal authority to act for that person, such as a power of attorney, and you disclose that when asked. The Website is not intended for use outside the United States.
3. Your information must be accurate
The information you submit is used to route your Financing Request and may be used by Participating Providers to evaluate it. You agree that:
- Everything you submit will be true, accurate, and complete to the best of your knowledge.
- You will only submit information about yourself, or about a person you are legally authorized to represent.
- You will not use anyone else's identity, Social Security number, bank account, or other personal details.
- If you learn that something you submitted was wrong, you will correct it or tell us using the contact methods published on the Website.
Submitting false information to obtain credit can be a crime. The Website Operator may decline, suspend, or discard any Financing Request it reasonably believes is inaccurate, fraudulent, or automated.
4. Credit report authorization
During the submission process, you will be presented with a separate credit authorization to review and accept. That separate authorization, not this section, is the binding consent. This section only summarizes it.
In short: when you accept the credit authorization and submit a Financing Request, you authorize the Website Operator and the Participating Providers that receive your request to obtain consumer report information about you from consumer reporting agencies and similar sources, as permitted by the Fair Credit Reporting Act, to verify your identity and evaluate your request, as described in the authorization. That may include a soft credit inquiry, which does not affect your credit score. A Participating Provider that considers your request may also perform a hard credit inquiry, which can affect your credit score, as that provider discloses to you, and each provider is responsible for its own credit practices and required disclosures.
If you do not accept the credit authorization, you will not be able to submit a Financing Request.
5. How matching and routing works
When you submit a Financing Request and give the required consents, the Website Operator routes your information to one or more Participating Providers, including through routing platforms. You should know how that works:
- Routing decisions may consider your eligibility information, your state, provider availability, technical routing rules, and the compensation the Website Operator may receive.
- Because compensation can influence routing, the recipient of your Financing Request is not necessarily the lender offering the lowest cost or the best terms for you.
- The Website Operator does not rank, endorse, or recommend any particular lender, and does not compare every provider or product available in the market.
- A Financing Request may be offered to more than one recipient, and a recipient may decline it. You may be contacted by one or more recipients, or by none.
6. Participating Providers are independent businesses
Every lender, lending network, and routing platform that receives your Financing Request is an independent business. The Website Operator does not control and is not responsible for:
- their credit decisions, eligibility standards, offers, rates, fees, or terms;
- their loan agreements, disclosures, or required notices;
- their communications with you, servicing, collection practices, or privacy practices;
- their websites, applications, or any content they provide.
Any loan offer is made solely by the provider issuing it and is governed by that provider's own agreement with you. Read any loan agreement and its disclosures carefully before you sign. If the Website links to third-party websites, those links are provided for convenience only and the Website Operator is not responsible for their content or practices.
7. Your privacy and your choices
The Website's Privacy Policy explains what information is collected, how it is protected, how long it is kept, who it may be shared with or sold to, and the choices and rights you have, including how to request access to or deletion of your information and how to use the Do Not Sell or Share My Personal Information page on the Website. The Privacy Policy is part of how the Website operates, and you should read it. Communication consents, such as consent to marketing calls, texts, or emails, are presented separately during submission, are optional where the law requires, and can be revoked as described in those consents and on the Website.
8. Intellectual property
The Website, including its text, design, graphics, logos, software, and the Swiftlendly name, is owned by or licensed to the Website Operator and is protected by intellectual property laws. You may use the Website for your own personal, non-commercial purpose of requesting a loan and managing that request. You may not copy, republish, sell, scrape, or create derivative works from the Website or its content without the Website Operator's prior written permission. Trademarks and provider names that appear on the Website belong to their respective owners.
9. Acceptable use
You agree not to:
- submit false, misleading, or stolen information, or impersonate any person;
- use bots, scripts, scrapers, or any automated means to access the Website, submit forms, or collect data from it;
- probe, scan, or test the Website's security, or attempt to access accounts, systems, or data you are not authorized to access;
- interfere with the Website's operation, including by overloading it or introducing malicious code;
- use the Website to violate any law, or to build a competing product or database;
- resell or commercially exploit the Website or any data obtained through it.
The Website Operator may investigate suspected violations, may suspend or block access, and may report unlawful conduct to law enforcement.
10. Disclaimers of warranties
The Website and its services are provided "as is" and "as available." To the fullest extent permitted by law, the Website Operator disclaims all warranties, express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement. The Website Operator does not warrant that the Website will be uninterrupted, error free, or secure, that any Financing Request will be routed, accepted, or answered, or that any loan, rate, or term will be available to you. Some states do not allow the disclaimer of certain warranties, so some of the above may not apply to you.
11. Limitation of liability
To the fullest extent permitted by law:
- The Website Operator is not liable for the acts, omissions, offers, agreements, communications, or conduct of any Participating Provider or other third party.
- The Website Operator is not liable for indirect, incidental, consequential, special, exemplary, or punitive damages, or for lost profits, lost savings, or lost opportunities, arising out of or relating to the Website or these Terms.
- The total liability of the Website Operator for all claims arising out of or relating to the Website or these Terms will not exceed one hundred United States dollars.
These limits apply regardless of the legal theory and even if the Website Operator was advised of the possibility of the damages. Some states do not allow certain limitations of liability, so some of the above may not apply to you. Nothing in these Terms limits or waives any right you have that cannot be limited or waived under applicable law, and nothing in these Terms limits liability for the Website Operator's own fraud or willful misconduct.
12. Indemnification
You agree to indemnify the Website Operator against third-party claims, and the reasonable costs of defending them, to the extent the claim results from (a) information you submitted that you knew was false or that you had no right to submit, or (b) your violation of Section 9 (Acceptable use) or of applicable law in your use of the Website. This obligation does not apply to claims arising from the Website Operator's own conduct, and it does not apply to your ordinary, good-faith use of the Website.
13. Dispute resolution and governing law
These Terms are governed by the laws of the state in which the Website Operator maintains its principal place of business, as identified on the Website, without regard to conflict-of-law rules, except where the law of your state of residence applies to you as a consumer and cannot be varied by agreement.
Disputes arising out of or relating to the Website or these Terms will be resolved in the courts of that state, unless a separate dispute resolution agreement or arbitration provision is presented to you on the Website and accepted by you, in which case that agreement controls to the extent it applies. Nothing in this section takes away rights you have under consumer protection laws that cannot be waived.
Before starting any formal proceeding, we ask, but do not require, that you contact us using the contact methods published on the Website so we can try to resolve the issue directly.
14. Termination
You may stop using the Website at any time. The Website Operator may suspend or terminate your access to the Website at any time, with or without notice, including for violation of these Terms. Termination does not affect consents you have given or revoked, your privacy rights, or any provision of these Terms that by its nature should survive, including Sections 8 and 10 through 13.
15. Changes to these Terms
The Website Operator may update these Terms from time to time. The updated Terms will be posted on the Website with a new last-updated date, and material changes will be communicated as required by law. Changes apply going forward from the date they are posted and do not change the terms that applied to a Financing Request you already submitted. If you keep using the Website after updated Terms are posted, you accept the updated Terms.
16. General
If any part of these Terms is found unenforceable, the rest remains in effect. The Website Operator's failure to enforce a provision is not a waiver of it. These Terms, together with the Privacy Policy and the consents and authorizations you accept during submission, are the entire agreement between you and the Website Operator about the Website. You may not assign these Terms; the Website Operator may assign them in connection with a sale or transfer of the Website or its business, subject to applicable law.
